Upon arriving at the scene, Gaede made contact with Kolton Griffith, 27, a resident believed to be responsible for the fireworks activity. After developing probable cause for arrest, Gaede attempted to place Griffith in handcuffs.

What followed was a sudden and violent escalation. During the attempt to arrest him, Griffith began to resist and a struggle ensued. It was during this altercation that Griffith pulled a concealed handgun and opened fire, striking Deputy Gaede.
